In Medical Malpractice cases there is a set time for filing suit. If a plaintiff does not file suit within the prescribed statute of limitations (which can vary depending on whether a minor or adult was involved and when the plaintiff learned of the injury), then the patient/plaintiff has no further legal remedy.

After a lawsuit is filed, the parties may agree to settlement at any point.
