Legal Question in Real Estate Law in Maryland

How do I Deed land in my name that is owned by my father.

My father owns 127 acres in Frederick, MD. He has offered to give me 1 acre of land so I can build a home on it. How would I go about deeding this 1 acre into my name? Also, he is only charging me $100.00 for it. Will there be any fee's I have to pay because it is so cheap?

First, you will need to mark off the lot boundaries and have a professional surveyor give you a "metes and bounds" description of the carved out lot. Then have a real estate attorney prepare a deed containing that description. Once your father (and any other owners of record)sign the deed, the property becomes yours.

You can avoid paying any transfer and recordation taxes if the property is transferred without any consideration. (Take him out to dinner for the $100). There will be some small recording fees. There is also exposure to the federal gift tax; consult your tax adviser about that.
