Legal Question in Real Estate Law in Maryland

I got married in 2010, my husband and I each own a home. He is living in mine and his son is living in his. Can we file jointly and each claim the mortgage interest? We live in Maryland.

Yes, and in addition if your husband's son is renting from him he can take depreciation on his home as an investment property, as well as any other expenses he incurs for maintenance, etc.--but he has to declare the rental income as well.
