Separating, is wife responsible for half rent?

My wife decided to move out of our rental townhome recently after deciding that we don't work. Both of our names are on the lease which we have until November 2001 and she has stated that she will not pay her end of the rent now that she is out. Can I hold her liable for this or what can I do to get what she committed to?

If you are both on the lease, you are each responsible for the full amount of the rent. In a non-marital situation, to the extent that one pays all of the rent, that person is allowed to seek contribution from the non paying tenant for one half of what he or she has paid.

One thing to keep in mind - if your wife is intentionally excluded from the property, she may be relieved of any further obligation.

Furthermore, there may be support issues that would complicate recovery of the monies. You may want to discuss this matter with a domestic relations attorney.
