Legal Question in Real Estate Law in Maryland

i had a survey done because i thought my neighbor put his feance up on my property. come to find out i was right. i asked him to move it and he said no take me to court. can i just cut it down? if not what can i do about this? im located in baltimore county maryland

There may be an issue as to whether the fence has been there long enough to give him a claim of adverse possession of the part of your property that is within the fence. If it's been there for 20 years he could make such a claim. You can file a court action seeking an order requiring him to remove the fence from your property and see if he asserts this defense. Before you do that I suggest you put him on written notice that you will seek legal fees and costs if he forces you to go that way.
