Legal Question in Real Estate Law in Maryland

Trees on Property

There are trees on my property that my neighbor say's are blocking her view coming out of her drive way. Those trees have been there for over 25 years, she has only been there for a couple of years. I know she is only harrassing my family by this claim. She is has put a letter in my mail box claiming she will sue us if we do not cut them down. Does she have a case?

Re: Trees on Property

You may want to check your home owners' association rules and regulations regarding tree and lawn maintenance issues. If there is no such document, the common law of Maryland allows a property owner to cut back trees and shrubs that over hang the property line. If the trees are in bad shape and eventually fall on her yard, you may be liable since she has given you notice of the problem. A little neighborly prunning might be in order, but she does not have a case if the trees are entirely on your property.
