Legal Question in Social Security Law in Maryland

I have permanent guardianship of my grandchild who receives social security survivor benefits based on his deceased biological father's work history. If I adopt him, will he lose the benefits?

He may not lose his benefits, but they may be effected. When you adopt, you become the legal parent of the child, and therefore your income is generally attributed to the income of the child. Is there a specific reason that you want to adopt as opposed to being the child's permanent guardian? I would strongly advise that you speak with a Maryland SS benefits attorney before you make any formal moves towards adoption so that you are very clear on the consequences both for yourself and your grandchild of adopting him.
