Legal Question in Wills and Trusts in Maryland

minor beneficaries

If my husband's will states a guardian over my minor daughter for his money in his will, what are my rights as her mother? What if his will is not a guardian but a trustee or some other form?

My husband has told me his will states that when he dies, all of his money will go to our 6 year old daughter. He tells me he has placed someone else to be her guardian over this money.

I would like to know first, if he can do this? and secondly, if he does do this, what are my right in regards to this guardianship he created? I would still be her legal guardian because I am her mother. Does it mean I would have to ask this other guardian for grocery money???

Can there be two guardians for the same minor?

I hope this helps.

Thank you.

Re: minor beneficaries

As his wife, you are entitled to a statutory share of his estate. He can place the assets and money he leaves for your daughter in a trust and assign a guardian, and he can assign someone other than you as guardian over that property.
