The attorney's fee is controlled by a formula set forth in the worker's compensation law. The attorney can request a fee up to the maximum allowed in the statute, which is generally $7500. The fee will be a product of the value of the award he negotiated or won for you. He/she will ask you to consent to the fee petition, and will then submit it to the workers' comp commission for approval. Once approved, the fee will come off the final weeks of the settlement. If you've negotiated to receive a lump sum, it will be deducted from that amount.
