Paystub retrieval

What is a company's obligation regarding an employee's request for copies of past paystubs? Is there a time frame within which the company is obligated to retrieve them (i.e. 5 years back, 10 years back, etc.?)

I think you need to make a reasonable effort to get the employee copies of the stubs within about a week of the request.

If you have stubs for more than a year, and these are easily accessible, you ought in good faith to provide such copies.

If the period of time extends beyond 2-3 years of stubs, then you may want to advise the employee that there may be a research charge for these. If the stubs or the information is either in the employee's personnel file or on computer, you probably need to provide these.

Contact the IRS or your local Department of Labor as they may be able to tell you how long these records must be maintained. Good Luck!
