Legal Question in Civil Rights Law in Massachusetts

My sister has a home, her name is the only name on the Mortgage.She left this home to get away from an abusive boyfriend. He was the one paying the Mortgage and she was told by the police that if he was paying the Mortgage then her being the owner doesn't matter and they couldn't make him leave?

As part of a restraining order, the abuser can be ordered to vacate the share home, regardless of who owns it. You may want to speak with an attorney about whether a restraining order makes sense for you.
