Legal Question in Consumer Law in Massachusetts

Hi, I ordered 6 Wedgewood Jasper Conran Chinoiserie plates in GREEN for my daughters wedding.. last September from the Cozy Pineapple. They sent the white dishes.. NOT green.. MY daughter has no use and didn't even like them in white... I tried over and over to get the address from the Cozy Pineapple to send these back.. I had put them on a charge card of Chase.. so I disputed the charges and tried to get address with no luck.. months and months and months went by.. and they disputed it because my Daughter who lives in San Diego could not send them back without an address.. there wasn't one.. when delivered... so this went on with Chase Master card for months.. we got the address and sent them back in Feb. Feb.6th to be exact... I was given the run around with Chase for months and Months.. sent them proof of return at least 3 times.. faxes, mail.. phone talks with there merchandise disputes.. finally yesterday.. they said they would not give me the credit on my account it was too late... They and Cozy Pineapple have been giving me the run around since day one.. They have the plates yet ... they will not stop billing me $279.00 on my credit card. CAN YOU HELP ME.. these were Wedgewood dishes I would like to go after all of them ... wedgewood for not picking a more honest supplier, Chase for stealing my money and charging me for something I do not have.. and it was wrong to begin with ...and the Cozy Pineapple for just being totally dishonest sending the wrong dishes when they knew I ordered GREEN.. and did not want white.. I talked to Tim Myself and he said he would send the green ones.. this was in the very beginning when thery were ordered.. Now this company is still online scamming others.. they have a terrible record.. at least with me.. I work very hard and feel being scammed for $279.00 is just not right... CAN you help me.. I am desparate.. My daughter deserves a wonderful wedding present... and I want this settled... My daughters name is Katie and mine is Patricia ... my email is [email protected]... Could you please tell me what I can do.

This is really a injustice and I feel used by all three companies.. Did I mention I have had Chase Mastercard for over 30 years... Thank you ahead of time for any help you can give... I am sick about this.....

Sincerely,

P. J. MacFarlane

ANSWER:

Dear P. J. MacFarlane:

Thank you for your question. It is so disturbing to shop on-line and have an experience such as the one you describe.

Important questions that must be answered prior to giving a definitive response to your excellent question are:

1) Do you have your bill of sale/sales contract?

2) Have you notified all parties in writing about your position in this dispute?

3) If "yes" to #2, what was their response?

4) Do you have your bill of sale/sales contract and all subsequent written emails or written correspondence?

5) What resolution are you seeking from all parties at this time?

General Response:

When you reply to the above questions I will provide you with a more detailed response.

General speaking I would suggest the possibility that Chase and Cozy Pineapple may be in violation of federal and Massachusetts consumer protection laws. They are both handling this matter poorly.

You may consider contacting this law office directly at 508-265-1092 or 877-292-1177 for a free telephone consultation. Usually we can represent you without charging you attorneys fees. If we win this matter on your behalf, the defendants will pay our legal fees. Warren E. Wood, Esq. ([email protected]).
