Legal Question in Credit and Debt Law in Massachusetts

ma law on social security disability and debt collector

My husband and I are both on Social Security Disability and are being contacted by a debt collector. In fact they have contacted my husbands parents trying to get a hold of us. What are the laws in this case?

The fact that you are on SSDI only indicates that you are a "protected income" from which a court will not order you to pay. This does not say whether you have an attachable asset. So, if you owe the debt, and the debt collector can and does sue you, they may be able to obtain a judgment against you. They may not be able to get payment order though.

Depending on what they said to your husband's parent's, this debt collector may now owe YOU money.

Please review the information at my website [www.StopCalls.Net] and contact me for a free case evaluation. Please do not let these debt collectors break the law and get away with it. Enforcing the law will come at no cost to you and I will fight to get you compensation.
