Car racing

My son was arrested for racing his car.. what is the punishment for this? Also, he is currently on probation for simple assault..which was continued without a finding.What will happen to him?

There are several ways a person can be charged with racing including simply speeding. Therefore, with some sympathetic facts and good representation your son may not be punished too badly on the racing. On the Probation Violation, a new arrest is typically sufficient for a finding that a probationer is in violation. This means that the judge can do anything from nothing at all to imposing the guilty and imposing the punishment for assault. Without more deatiled information I could not predict the outcome, but he certainly should have representation. The money saved by not hiring an attorney will be long spent and forgotten while his record will stay with him all of his life.

If your son is convicted, he may receive a fine between $20 to $200 and/or imprisonment for mandatory minimum of 2 weeks and up to 2 years in the house of correction. He will also lose his license for 60 days if this is his first offense; if he has a prior, he will lose it for 1 year.

Similarly, there is a range of what can happen with regard to the probation matter. Worst case scenario is that a guilty finding will enter on the assault charge and he will be sentenced.

The CWOF, if he still on probation, can be changed into some other disposition. As to the racing, this depends on the gravity of the situation.
