Legal Question in Criminal Law in Massachusetts

wife forges power of attorney

The wife forges her husband's power of attorney with her best friend as the notary. he was completely unaware that she then refinanced the mortgage for $60,000 more since she forged his signature on one and had false power of attorney on the otherHave the documents that show it is a forged signature. They are now in the middle of a divorce and he found out about all of it when he searched through the registry of deeds records. What will be her penalty/punishment? and the notary's? What will this do for him in the divorce? Is it a felony? Is there a statute of limitations?

Re: wife forges power of attorney

first of all this should be reported to the police.

Any transactions under this forged document should be nullified.

As for the divorce it goes to the credibility; and if you need assistance contact me.
