Legal Question in DUI Law in Massachusetts

DUI but not arrested

On Friday I was involved in a collision

with a parked car. I was brought to

the hospital and the blood test

showed I was over the limit. I was

not read my rights or arrested but I

know I will be charged. How will I be

notified? Will I be arrested and

booked?

You will likely receive a summons with a citation. But retain an attorney immediately to see if you can prevent the prosecution from obtaining your hospital records. Good Luck!

First and foremost - retain a lawyer NOW. Our office has had great success in keeping hospital records out of the hands of law enforcement under these circumstances. The sooner you begin this process, the better your chances of success.

You are correct that you will be charged with OUI. It is highly unlikely that you will be arrested and taken into custordy. You will most likely be mailed a summons to appear for arraignment. You are doing the right thing by seeking legal counsel now. Don't wait for the summons to hire counsel. Hire an attorney who specializes in OUIs.
