Legal Question in DUI Law in Massachusetts

leaving while on probation

I have a friend who was convicted of DUI. He was placed on one probation year mail in probation (he mails in $65 monthly, address and employent status) and was told to attend a 16 week first offender program. My friend is homeless, unemployed and recently divorced. He was planning on relocating to Puerto Rico. Prior to his conviction he had already sent all of his belongings to Puerto rico. Since this has happened can he still go or will he need to stay in Massachusetts? The problem with staying is that he has no where to live, no family and no source of income. Should he tell his probation officer the situation in hopes of being allowed to leave? What will happen if he leaves and keeps mailing in his fine? Will they allow him to attend the 16 week program somewhere else?

Re: leaving while on probation

He needs to tell his probation officer and get permission from the court to leave the state and do the program elsewhere. The registry may not accept an out of state program and he risks losing his MA license for 1 year. Please feel free to contact me further. Martha Kovner
