Legal Question in Family Law in Massachusetts

child custody

My son lives with his father in MA, I live in MN, all custody decisions have been made out of ND, we both use to live there-not for over 3 years. My son is having troubles with grades and attitude and I feel he would be better off living with me his mother, his dad has custody from ND, which state should I procede out of for custody, my son is 15 yo, my ND attorney says it would be to hard to try out of ND.

I see you as having two choices. If your son will come to Minnesota and move in with you, then you can bring a motion in Minnesota for a child custody order. Otherwise you better hire a lawyer in MA and proceed there.
