We had a GAL that ws given detailed instructions in 1998 what his report should include. It took him 7 reports to do this at the emotional & financial cost of my family. His reports have ranged from 1998 with his last report completed in August of 2008. Do we have a malpractice suit against the GAL?

Thi is a very unique case where a biological father has been fighting for custody of his biological daughter since 1998 from the maternal uncle. The father was never proven unfit & the probate judge issued co-guardianship & the father appealed & the case has been vacated back to the lower court judge who has yet to make a decision. This has gotten out of control & is truly ridicuolous. We have invested enough money in this & have to keep doing this because the judge keeps dragging his feet.

In the last GAL report the GAL had finally stated that the father is a fit parent & he was advised back in 199 to do this & never did. He based his reports on thebest interest of the child not the fitness of the parent.
