Divorce and debts

My husband left me for another woman. He now wants to divorce. I am a homemaker and I know he has a debt with the I.R.S. I am also living at our house with our child, since he abandoned us. He says he will stop making payments on the house and let the bank foreclose. We have been married for 5 years. How can I protect myself from his debts?

You file for Divorce and get a court order requiring him to pay the mortgage and temporary support.

You should go ahead and file for divorce, and at the same time mark up a motion for temporary orders. Temporary orders will cover child support, custody, and could order him to pay the mortgage (though this isn't guaranteed, and depends on the attitude of your judge).

Definitely call an attorney to get moving. Child support is almost automatic.

Be proactive. Retain an attorney immediately to file for divorce in which you can ask the court to order him to pay the mortgage and child support and perhaps even extend an allowance to you to pay your attoney's fees, if necessary. Good Luck!
