alienation of affection

My husband abandoned our family last fall for his girlfriend. I filed for divorce this past summer after 19 years of marriage. His girlfriend has just won a multi miliion dollar settlement. My question is do I have a case against her for breaking up my family?

I am sorry for your trouble. While alienation of affection is no lomger actionable in Massachusetts, you should have an attorney representing you in a divorce wherein you might seek higher child support and alimony if he is living with her and benefitting from her paying all the living expenses for both of them. There is no alienation of affection under MA law, nor has the court allowed spouses to seek compensation for intentional infliction of mental distress.

If you do not have a divorce attorney, I suggest you get one. His abandonment of his family may impact the division of assets and his obligation for support.
