Legal Question in Family Law in Massachusetts

medicated for breakdown and depression

hi i divorced my millionaire husband 8 years ago and accepted $20k and sold him our house for $1. He refinanced the house we owned outrite and took out equity several times possibly forging my name. I was being treated for a mental break down at that time. Our records are sealed at his request because he is a ''public figure''. Can I sue him? Do i have any recourse?

Re: medicated for breakdown and depression

The length of time involved here makes any effort to reopen the case difficult to say the least, if not impossible. You would have to show new evidence of egregious misconduct by your husband at the time of divorce -- fraud or overbearing due to your condition -- a lack of representation to you, the husband's hiding of his millions at the time, and so on. As to the forgery on refinancing -- which he would not need if you sold him the house -- again, I have doubts, but do not know enough facts. Frankly, if he forged your signature, he defrauded the bank, not necessarily you.

If you sold him the house, and the divorce is over, I do not see the relevance of the forgery.
