Legal Question in Family Law in Massachusetts

Modification

Hi

Should i agree to additional 10% becouse my child is 18? She is just taking me to court becouse the birth of her new child. It's very unfair. I already paid 10% when she turned 16 and every year she is entitled another 10% its crazy. Thanks for your time.

Re: Modification

You should engage an attorney, especially as this appears to be a follow-up question.

Unless your child is going to college or trade school, there is no legal reason stated in your post to raise your child support.

You of course always want to look at the cost of suit -- lawyers, time lost from your own employment, etc., against the requested increase. In addition, if she has a child under the age of 6, she likely cannot be deemed to be able to return to work herself. However, before she takes advantage of that, the father of the infant should be paying support.

You are obligated to support children you fathered. You are not obligated to directly support children you did not father.

Re: Modification

If your daughter is 18 and not a full time student, you may be able to terminate your child support altogether. However, she may not as a mother of a child be able to support herself which may be more complicated.

You should engage an attorney to assist you, but you are not responsible to support your grandchild. The father of the child should be paying child support.

I would suggest you contact an attorney.

Good luck

No -- she is not entitled to an increase 10% each year.
