If both parents are unemployed what are the legal ramificiatiions if one party is 3 months behind with child support?

The party who has an obligation to pay child support is in contempt. You should find an attorney to bring a complaint for contempt. If the payor parent needs to modify the current support order, he or she must do so. You are not permitted to simply stop paying. Good luck!
