Legal Question in Medical Leave in Massachusetts

I am having weight loss surgery. I have been at my current job for nine months. Can I use FMLA or do I write a letter stating I need time off ? Can my job fire me if I have a doctors note ?

Hello,

You are not generally not eligible for leave under the FMLA until you have been employed at your current job for one year (and your employer has more than 25 employees). Depending on your medical condition, you may have some job protection under the Americans with Disabilities Act if you require a leave of absence because of a disability. You should contact an attorney.
