Legal Question in Immigration Law in Massachusetts

Marriage to a US Citizen

My mother married a US Citizen back in 2005. She would like to become a U.S.Citizen. Does she have to take the Citizenship Test or is there another way for her to become a U.S Citizen through her Husband?

Yep, she has to take the citizenship test unless she falls under an exemption such as mental inability to learn English which must be documented, or some other disability. Tell her to start studying. She will pass. good luck.

She'll need to get her green card first, if she is not a permanent resident already, before she can apply for citizenship.

It's probably easier if you contact me with the details.

Re: Marriage to a US Citizen

I am not clear from your question if your mother has applied for a greencard based upon her marriage to a US citizen. If she has been married to a US citizen and has had her greencard for 2 years and nine months, she can file for naturalization. However, unless she has disabilities that would prevent her from learning the required information, she would need to take the test. If you have further questions please email my office to set a time to speak.

Re: Marriage to a US Citizen

She must first apply for a Green Card or Lawful Permanent Residence Status. Once she has the Green Card then she should wait three years (about) and then she can apply for Citizenship. Be sure to confirm that she entered the U.S. in valid nonimmigrant status or there may be complications with the Green Card application part of the process.
