Hi, our employee has caused damage in the car that belongs to our company in the amount of 800.00. We have withheld his paycheck in the hope to receive the payments regarding the expenses with toll and repair. Can we withhold his paychecks until he dicides do pay us.How should we proceed in order to recover the damages he caused us.

No, you should absolutely not withhold his paycheck. You may have subjected yourself to triple damages and attorney's fees in the event that your employee files a complaint. You need to seek damages from your employee, but you do not take it away from money he has earned unless a court tells you that you may.

You may want to retain counsel to make sure that, whatever the resolution to this matter that is reached, you are protected.
