Legal Question in Employment Law in Massachusetts

Work Suspension

My husband's firm has been

experiencing a slow down in work.

Senior management asked his dept.

to use their accumulated timeoff. As

a result, my husband took Friday

afternoon off. That day, he was

called by his manager, at home, and

told that he was placed on Furlough

LOA. He is the oldest person in dept.

(60) and has been with firm the

longest No one else was furloughed.

He needs to work...but can't collect

unemployment benefits due to

''furlough'' status. We have children

in college. Is this fair of the

company? As an employee of this

firm, is he now ''on call'' and required

to go to work whenever they

ask...even if for just a few hours?

As a work-at-will state...can he look

for another job? Why don't they just

terminate him?

Re: Work Suspension

Although more information would be needed, it is possible that your husband has suffered illegal employment discrimination because of his age.

You should gather all your paperwork and contact an attorney in your area.
