Legal Question in Landlord & Tenant Law in Massachusetts

I have a noisey neighbor in my buiding. I have complained to my landlord numerous times and nothing has been done. Do I have the right to withhold my rent until the problem is taken care of?

No you do not. This is an unfortunate situation where I can totally sympathize with you. I to, have a noisey neighbor in fact several of them. The standard lease agreement states "quiet enjoyment", unfortunately this agreement is not between you and your neighbors. Your only recourse is to call law enforcement. If you have ever been down this road before, as the road ends you will find the police will have done nothing, you will fight all the more with your neighbors, the police will tell your neighbors that it is you who called, and word will get around that you other rat who calls the cops. My suggestion, as hard as it may sound, is it the situation is so intolerable, where the subset you on a daily basis then consider moving. Massachusetts law protects the meek, low lives and dirtbags. A horrible fact we have to live with.
