Regulations surrounding Art Spaces in MA

Are there any real estate regulations that must be followed when renting out an art space?

If so, where can these guidelines be found?

This is a space that is just used to paint/draw/practice music, and is not to be inhabited by the occupants...

It sounds as though you will be using the space for commercial, as opposed to residential purposes.

If that is the case, you will want to be up front with the landlord and make sure your lease contemplates and permits the type of use you are proposing. If you are the landlord, you will want to negotiate and execute a commercial lease.

The law regarding commercial tenant-landlord law is very different from the law of residential tenant-landlord, so it would be a good idea to speak with an attorney. There are no simple guidelines to speak of.

You should retain an attorney to drafted a commercial lease which is very different from a residential lease and should specify the purposes for which the leasehold may be used.

There are no standard guidelines.

The issue is one that relates to zoning and permitted uses in the space. You should check with the Zoning Administrator as to what is permitted in the space.

Then the building or health department may have requirements for certain uses such as painting or music practice areas as to interiors, availability of water etc depending upon use.
