What can I do if my tenant doesn't want me to put his heat on?

I don't want my pipes to freeze.

This answer is very simple. It is not the tenant who has his name on the mortgage, it is not the tenant who owns the building, it is not the tenant who will pay for the repairs when your pipes burst. You sir, own this building and are ultimately responsible for its operations. You turn that he on, set the thermostat to its lowest setting, 55�, and if this is unacceptable to your tenant, or your tenant takes it upon himself to turn the heating system off himself then my recommendation would be to issue a 14 day notice to vacate because he would be in direct violation of this lease agreement with regards to proper maintenance and care of the apartment.
