Legal Question in Personal Injury in Massachusetts

involved in car accident 1/5/10 while on hgwy as I came over the rise and looked down the road the right lane was impeded by a p/u truck spun sideways from black ice and the left lane an suv was stopped to watch on this 55 mph road . I hit my brakes and found that the black ice was there also and I had to decide to pull off the road into woods on the left side of road or else be forced to hit the stopped suv or p/u truck I managed to avoid both but my car was totalled in the process ,do i have any recourse against either vehicle as i believe they contributed to the accident and not having collision I lost almost 10,000 dollars on my vehicle thanks for any advice or help in this matter

You should hire counsel. No one answering questions to internet questions can solve this problem or collect money for you. You have chosen not to insure this risk so now you need to perform the role that your insurer would have, that is, to try to collect money from the responsible party. You will have to front attorney's fees and out of pocket expenses for court filing fees, service of process and court reporters, and hope to make a recovery.
