Legal Question in Personal Injury in Massachusetts

slip and fall

I had was involved in a slip and fall knee injury and needed an operation etc. We have not been offer and kind of settlement yet so we are going to trail. the question I have is they have PI on me can they use pictures of me doing things after the operation? and other things with out me being legally notifiy that they are taking pictures of me? Can they use them in the court of Law without us knowing of them and without getting permission from the courts to do and or from me?

Yes. Unless the pictures were kept from your lawyer and/or you and not disclosed until it was too late for you to take adequate steps to respond to the damaging pictures.

First you should have discussed this with your attorney.

The short answer is no permission is required to take pictures of you. Your attorney should have been provided with copies of all pictures and video which they intend to introduce.
