Legal Question in Personal Injury in Massachusetts

I valet parked my car and the attendant burned out my clutch. The insurance company denied my claim and I want to take them to court for the $1300. I have recently moved and do not live near to there office. What is my next step?

You can file a small claims action where the incident happened, or where you live. The latter depends on how far away it is and if it is within the State. You should also consider sending them a consumer protection 93A letter of demand.

You may have a hard time proving that it was the attendant who burned out your clutch.

Regardless, your first step should be to send a demand letter to the valet company pursuant to the Consumer Protection Act, General Laws Chapter 93A. Once you have met your pre-suit obligations, you may want to file suit in the small claims division.
