Legal Question in Real Estate Law in Massachusetts

equity entitlement on family home

i bought a home with my father and mother in 1982.

at the time only my father was on the deed and we were both on the mortg. until we sold it in 2006

I lived in the home and was on the motrg. thru duration paying all expenses at 50%

when the home was sold my father only gave me 20%

however I think I am entitled to 50% of the sale of the home

can I pursue him legally?

this is in the state of Mass.

at this point he is adamant at not

giving me the 50% as I requested from him.

Re: equity entitlement on family home

I think you both were on the note. If you were both on the mortgage, you would need to be on the deed.

What was your understanding when you bought the home?

Who put down the money on the home?

You have some difficulty in proving you are entitled to half, without having contributed part of the equity and without any documentation to prove it.

You need to consult with an attorney. Is the amount of money involved worth what could be a permanent break with your father.
