I am planning on buying some vacation property in Maine. I am trying to decide whether to buy land to build on later or buy an existing house. I would like waterfront (lake/pond). I understand there are a lot of zoning issues with the Federal Government with septic. I don't want to buy a piece of land then find next year I can't build on it. Any advice on what to watch out for before or some questions to ask before buying. Thank you.

The zoning of property is regulated by the town where the property is located. There are also federal regulations (Title V) relating to septic systems. Basically, they must pass an inspection prior to closing. I would suggest you check with the city/town government (probably building department) and obtain a copy of the zoning ordinance. The zoning ordinance regulates what type of structure can be built on a particular piece of land. If you find a specific property you are interested in, you can also speak with the city/town building department to see if a building permit could be issued to construct the type of house you want. I would recommend that you hire a Maine attorney who deals with Land Use (Zoning) to protect your interests or advise you on the process. You can make your offer contingent on obtaining a building permit.
