Legal Question in Tax Law in Massachusetts

Fradulant signing of federal tax return

My wife who is divorcing me because she had an affair signed my name to our joint tax returns. I have not seen them even though I have asked to see the returns. What is the likely penalty for such fraud?

All kinds of nasty stuff for her; no adverse consequences for you. Best to contact the IRS yourself about how you should proceed -- likely you will want to file a "married filing separately" return unless you can get hold of what your wife filed and ascertain whether there is anything amiss with it.

Be sure to consult with your divorce lawyer (don't have one? get one!) about what you can and cannot say about this situation.

Best wishes,
