Legal Question in Tax Law in Massachusetts

Town assessor

I am being taxed for a tractor that I borrowed from a family member. The assessor drove by my house and saw an unregistered tractor in my yard. The tractor was only in my yard for 2 days. The town stated that I had to pay the bill and prove that the tractor is not mine. Is this legal?

Yes it is legal, but you can demonstrate that it is not your tractor and show that you do not have it on your premises. Get a statement of ownership. Show that it is assessed to your family member for two days.

The Treasurer should amend the bill. Otherwise, you appeal to MA tax court.

Pay your tax bill as to other items on the bill if any.

Generally speaking , the town assessor within the Commonwealth of Massachusetts has a right to assess a tax upon the owner of personal property, unless such property is exempt (eg; household furnishings etc). Further, a tax may be assessed against tangible personal property leased for profit.
