Legal Question in Wills and Trusts in Massachusetts

My brother passed away last week. I've handled his affairs for the last 2 years. He did not have a will. I just found a document stating that he has about two thousand dollars worth of stock. What can I do to get this money to help pay for his services and other expences? Thanks

You file a Petition to open a small estate with County Probate Court in which he last lived. Assuming you are the sole heir they will open the estate very quickly for you and you will be appointed administrator. If your brother had other siblings or children, then you will need their consent to become administrator of his estate. If his bills and burial expenses exceed his assets you can file an Insolvent Estate.

Most Probate Courts will give you some assistance in completing the forms. You will need a certified copy of the death certificate to open the estate.
