Legal Question in Wills and Trusts in Massachusetts

My fathers attorney was disbarred and has moved out of the country. My father has passed away. We know he set up a trust 30 yrs ago and cannot locate his copy. Now what? Are trusts filed in each state? thanks

First, who administered his Trust?

If it was the attorney, I would contact the Board of Bar Overseers and see what happened to the attorney's files.

I would also check with the Probate Court where your father lived to see if there is anything on file there.

If you know where the trust has a bank account, you can petition the probate court and get someone appointed as Temporary Trustee and seek a copy of the trust from the bank. Most banks require a copy of the Trust to open a bank account.

I strongly suggest you contact an attorney as soon as possible.
