Legal Question in Wills and Trusts in Massachusetts

I'm traveling out of the country very soon, and want to make sure some one can handle my estate in case of my unexpected death. Can I do something in the next three days to assign someone fiduciary responsibility?

You will have to meet or speak with an attorney immediately (first thing tomorrow) if you are going to try and put something in place. I think the most meaningful thing that you can do immediately is execute a durable power of attorney, which grants to another person the right to transact business and handle your financial affairs and property for you.

The only way to make any decisions on your own behalf in the event of death is to execute a valid will. You will need to select a person in your geographic area because a will requires witnesses and other signing formalities. You can execute a Will naming someone as your Personal Representative to carry out your intentions.

You should also have a Durable Power of Attorney executed in case you do not die but become incapacitated and need someone to take care of your financial affairs.
