Legal Question in Wills and Trusts in Massachusetts

unsecured credit card debt.

My brother has a percentage of a waterfront cottage and is terminally ill with cancer. He has about $35,000 in credit card debt. Can they the credit card companies go after the cottage after my brother dies? What recourse do we have.

If it part of his estate, absolutely.

Whatever assets exist in his name, become part of his estate upon death.

Whatever assets he has as part of his estate are subject to claim by his creditors.
