Legal Question in Workers Comp in Massachusetts

Workmans comp back surgery

I've been on wworkmans comp for 2 mnths and after all the tests i took it has been decided to go with surgery. The concern i have is my workmans comp company wants a 2nd opinion and my back is in rough shape---looks like bone to bone.On cause of arthritis..I was fine until i lifted a eyewash staion at work and i felt a pop and pain immediatly down right leg..It's been like that ever since..My ? Is --if they decline to payfor it through workmans comp--will my regular insurance pay for it?

Re: Workmans comp back surgery

You need to contact an attorney. You file a claim with the Department of Industrial Accidents for payment of your back surgery. If the Insurance Company denies the surgery they will also stop your workers compensation checks.

You have other issues. What are you going to do for pay while recovering? If you are moving a eye wash station you must do physical work. Can you continue that type of work after back surgery? You should contact an attorney.
