Legal Question in Consumer Law in Mexico

Failure to reimburse contract

Hi there,

I live in Boston and was recently was married in Mexico, the resort had us switch dates 2 weeks prior to the event. In return, they sent a contract reimbursing us $2500 for our alteration. They charged us the full price on the date, and have failed to pay still (almost 2 months later). They do not respond to email of phone calls. What is my legal recourse?

Thanks

Before anything else, thanks for writing me at LawGuru.com

You can file your case, but you have a first option. You can get help from Mexican Federal Consumer's Attorney (Procuradura Federal del Consumidor) and if you have copy of your contract, you can contact and explain your case (available on english language too). If they can't help you, you can file your case in a local Civil Court.

Re: Failure to reimburse contract

If you have a valid contract you can sue the hotel for those $2500 USD, but you will have to hire a local attorney to do this for you. Depending on the jurisdiction, you will either have the opportunity to go through small claims court (Juzgados de Paz Civil) or ordinary first instance courts.
