Amelia advertised her car for sale in the Sunday newspaper �Proton Waja for sale. Good condition. RM30,000 for quick sale. Contact Ms Amelia at 012- 345678 or [email protected]�. Billy came to see the car on Tuesday, asked Amelia some questions about the car and told her he would give her a definite answer by Friday.
On Tuesday as well, Charles sent an email to Amelia which read �RM30,000 is too much � will you accept RM25,000?� Amelia read the email but did not reply to it.
On Wednesday, Donald came to see the car. After returning home he posted a letter to Amelia in which he said, �I agree to buy the car for the RM30,000 asked by you� but, before Amelia received this letter, Donald telephoned and told her that he did not want the car after all.
On Thursday Amelia calls Charles agreeing to sell the car for RM25,000. Charles goes over to collect the car with 2 cheques for the sums of RM12,500.00 each, one dated current and the other the following month. Amelia refused to accept them and left. Charles was furious.
Shortly thereafter on the same day, Eddie went over to Amelia�s house and paid Amelia RM30,000 cash for the car. Amelia took the money and gave Eddie the car.
Charles, wanting the car, sued Amelia for specific performance.
Billy goes over to Amelia�s place on Friday with a cheque for RM30,000 but is told that the car has been sold. He too wants to sue Amelia.
