Legal Question in Construction Law in Michigan

My builder used did not use a vapor barrier when he built out house 10 years ago and the cultured stone is starting to fall off the house causing major damage. The building inspector says we could have a civil case. What would our cause of action be considering it has been ten years.

The statute of limitations for construction defects is listed in the MCLA. It states that the party knew or should have known of the defect. Case law under this section will tell you how the courts have applied this in the past. See a competent lawyer in Michigan and he will be able to assist you. The outcome is case specific and there are many details to prove the case including the testimony of an expert witness.

Good luck!
