Legal Question in Consumer Law in Michigan

I was injured on the job, I am under workmans comp and currently working with restrictions. Can my employer post a help wanted ad under craigslist or any other classified ad for my job title even before being medically evaluated by a professional medical doctor? Kevin

It may be significant that your employer is already looking for your replacement, so print, date, and save any job posting that you think was posted by your employer. If you can PROVE that your employer posted your job (for instance, if your friend responded to the posting, and had the employer identify himself, as well as the specific job), this would be relevant evidence, in the event that you end up in litigation with your employer. However, it is not illegal for employers to post jobs that do not need to be filled, or even jobs that are non-existant. You need to continue to work your job to the best of your ability, and make sure that your employer knows that you want to continue working. If you are really concerned, start keeping a journal.
