Photocopy personal checks?

We run a small business in MI, and also maintain a mailing list of our customers (who knowingly signed up to be on). We do not share this mailing list with anyone.

1) is it legal to take our customers' mailing address off their checks and add them to our mailing list?

2) is it legal to photocopy personal checks so that we can add the info at a later time (of course destroying the photocopy afterwards)?

No, that isn't illegal. You clearly aren't taking any money from your customers that they haven't acknowledged owing you by writing the check in the first place. Nor are you taking anything else of value from them that you don't already have consentual access to. No harm, no foul!
