My husband is charged with DV against me. I stated to write out a statment, but I decided I no longer wanted to give a statement. I am also going through a case with DV against my husband and will be sentenced soon. When I told the officer I no longer wanted to give a statement and it was ok he told me that if I didn't sign my statement that I would be going to jail. Now the they are trying to get me to testify against my husband can I request not to testify or plead the 5th?

Just out of curiosity, who keeps calling the cops?

If you plead the 5th, the prosecutor may give you immunity and you could be directed by the judge to testify.

No judge I know has ever put a wife in jail for contempt by refusing to testify against her husband. If you were not injured by him, you could just keep silent. Your choice!

NO FAMILY SHOULD EVER CALL THE POLICE TO INTERVENE IN DOMESTIC DISPUTES WHEN ACTUAL PHYSICAL INJURY IS ABSENT.
