Legal Question in Criminal Law in Michigan

Larceny

A guy I was dating, loaned me approx. 420 dollars, While he waited in the car, I went into the gas station and with the pin number he provided to me, removed the money from the ATM. Now, since things didn't work out, he is claiming theft. I am on the ATM camera taking the money out, But logically, he had to provide the PIN and he also is on the outer camera in his car waiting.. Is this a felony and what should I do

Re: Larceny

Did he file charges yet? If he does, then contact a lawyer immediately. Also, it will be your word against his - and I doubt that he filed a police report or contact his credit card company to report any fraud/theft of his card right after the transaction, thus making his story weak.

Don't do anything less you are charged with a crime - then get a lawyer. If the police call you to investigate prior to pressing charges, politely explain to them your side of the story, and that you have since parted ways with the guy, and hopefully they will believe you, given the weak facts in this case.

Good luck.

Re: Larceny

It is most likely not a felony. It would be a misdemeanor, if anything. Are you formally charged with a crime? If not, it may never come to charged if the police don't buy his story. If you are charged, contact me for a free phone or e-mail consultation. Tim Klisz www.kliszlaw.com

Re: Larceny

You should hire an experienced and aggressive attorney to fight for you. If he made a false police report about this, he's the criminal, not you.
